The Commerce Clause of the U.S. Constitution grants Congress the power to “regulate commerce . . . among the several States,” and for more than 100 years federal lawmakers invoked it for a very narrow purpose—to prevent states from imposing trade barriers on each other. But today members of Congress act as if it gives them the authority to do just about anything—including forcing you to eat your vegetables.

During her Supreme Court confirmation hearings, Elena Kagan seemed to accept that the Commerce Clause could, in theory, give Congress the power to dictate what Americans eat. And what about ObamaCare’s “individual mandate,” which forces Americans to purchase health insurance? ObamaCare opponents are lining up to challenge its constitutionality, but supporters say it’s justified—you guessed it—under the Commerce Clause.

How did a clause intended as a restriction on states wind up giving Congress a green light to regulate noncommercial, local, and purely private behavior? How will ObamaCare stand up against the legal challenges brought by the states? Legal titans John Eastman (Chapman University Law Professor) and Erwin Chemerinsky (Founding Dean, University of California, Irvine School of Law) slug it out to to determine whether or not Congress has been abusing the commerce clause.

The New Orleans School Voucher Program

Before Hurricane Katrina ravaged New Orleans in 2005, Orleans Parish public schools were failing miserably. After the storm shut down the public school system completely, there was little reason to be optimistic.

But then something amazing happened.

The state of Louisiana took control over most of the schools in the district and has been chartering those schools ever since. This fall, more than 70 percent of the students in New Orleans will attend charter schools. (Check out reason.tv’s Katrina’s Silver Lining to learn more about the New Orleans charter school revolution.)

And then in 2008, Louisiana enacted the Student Scholarship for Educational Excellence Program, a pilot voucher program designed to allow students in failing schools to attend private schools in the area.

Congressman Perriello who had the audacity to claim to be a libertarian restricts free speech!

Congressman Perriello (D) of Virginia’s 5th District who has recently been trying to portray himself as a small “l” libertarian just proved once again that he is of the authoritarian persuasion. Watch the video below and see for yourself.

Congressman Perriello clearly does not understand the concept of free speech.

Austrian Economics

Only one school of economic thought has produced economists who predicted all of the following:

  • The Depression of 1920-21
  • The Great Depression
  • The Crash of 1987
  • The Dot Com Bust
  • The Latest economic mess

This school of thought is the Austrian School.  The central part of  this school of thought is it’s theory of the business cycle.  This theory is what has enabled Austrian economists to predict so effectively. Cannabinomics

Christopher Fichtner is a psychiatrist and the former mental health director for the state of Illinois. In his new book, Cannabinomics: The Marijuana Policy Tipping Point http://www.cannabinomics.com , Fichtner predicts that marijuana policy is about to change radically. As Fichtner points out, three public policy trajectories converging. The medical marijuana movement is gaining momentum. People are increasingly waking up to the fact that drug prohibition creates more public health problems than it solves. And, in the same way that the Great Depression caused people to reprioritize how we spend our public dollars, the current economic crisis has got people thinking that bringing the biggest cash crop in the US out into the open might not be such a bad idea. Judge Jim Gray on The Six Groups Who Benefit From Drug Prohibition

In 1992, Jim Gray, a conservative judge in conservative Orange County, California, held a press conference during which he recommended that we rethink our drug laws. Back then, it took a great deal of courage to suggest that the war on drugs was a failed policy.

Today, more and more Americans are coming to the realization that prohibition’s costs—whether measured in lives and liberties lost or dollars wasted—far exceed any possible or claimed benefits.
